The Enforcement Committee’s function is to conduct
hearings and make decisions regarding Notices of Violation (NOVs).
Four documents outline the various rules and
regulations: the Declarations of Covenants; the Articles,
Bylaws and Rules and Regulations of the Homeowners
Association; Canyon Club Rules; and Builder / Contractor
Rules and Regulations.
NOVs are issued in several ways; by Emergency Services
officers, by the Design Review Committee or by the General
Manager of the Association. Hearings are conducted monthly
for any NOVs for which prescribed fines have not been paid
prior to the scheduled hearing, or which are appealed by the
charged party, or which are mandatory because of egregious
or unique circumstances, or for which voluntary remediation
has not been accomplished.
NOVs and complaints considered by the committee are varied,
but most commonly pertain to traffic offenses,
non-compliance with covenants or design review directives,
unauthorized damage to or destruction of natural vegetation,
unapproved landscaping, uncontrolled pets, and
builder/contractor noncompliance with work directives and
rules and covenants.
